Terms of Service

These Terms of Service ("Terms") govern your use of onvybe.com and related services provided by OnVybe, Inc. ("OnVybe," "we," "us"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are

OnVybe is a platform that helps people discover, ticket, host, and manage live events. OnVybe is a technology provider and, except where stated, is not the organizer, host, or operator of the events listed on the Services.

2. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase tickets. You are responsible for keeping your account credentials secure and for activity under your account.

3. Using the Services

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms.
Resell or transfer tickets in a manner prohibited by an event's host or applicable law.
Interfere with, disrupt, or attempt to gain unauthorized access to the Services.
Submit false information or impersonate any person or business.

4. Tickets, Payments & Refunds

Purchases. Ticket prices are set by hosts. A service fee may be added at checkout or absorbed by the host, as shown before you pay. Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms.
Refunds. Unless an event's stated refund policy provides otherwise, all sales are final. Refund policies are set by hosts and shown on each event. Where an event is cancelled, refunds are handled according to that event's policy and applicable law.
Chargebacks. Initiating a chargeback without first contacting us or the host may result in suspension of your account.

5. Event Access & Conduct

Admission to any event is subject to the host's and venue's rules, including age, dress code, and identification requirements. Hosts and venues may refuse entry or remove attendees consistent with their policies and the law. A valid ticket does not guarantee entry if such conditions are not met.

6. Hosts & Payouts

Hosts are solely responsible for their events, including accuracy of listings, delivery of the event, required permits and licenses (including alcohol), safety, and compliance with all applicable laws.
Hosts receive payouts through Stripe Connect and must complete Stripe's onboarding. OnVybe's platform fee is disclosed to hosts.
Hosts agree to honor the ticket and refund terms they publish and to resolve attendee issues in good faith.

7. Content

You retain rights to content you submit (such as event flyers and descriptions) and grant OnVybe a license to host and display it for operating the Services. You are responsible for ensuring you have the rights to any content you upload.

8. Text Messages (SMS)

If you opt in to SMS, you agree to receive recurring automated event and marketing text messages from OnVybe at the number you provide. Consent is not a condition of purchase. Message frequency varies and message and data rates may apply. Reply STOP to cancel or HELP for help. Full details are in our SMS Terms.

9. Disclaimers & Limitation of Liability

The Services are provided "as is" without warranties of any kind. OnVybe does not organize or control events and is not responsible for the acts, omissions, safety, or conduct of hosts, venues, or attendees. To the fullest extent permitted by law, OnVybe's total liability arising from the Services will not exceed the amount you paid to OnVybe in the three months before the claim, and OnVybe is not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold OnVybe harmless from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

11. Changes & Termination

We may update these Terms or the Services at any time. We may suspend or terminate access for conduct that violates these Terms. Material changes will be reflected by an updated date above.

11. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in Louisiana, unless otherwise required by law.
